Please note that it is essential to read and understand these conditions of booking as written below ("Booking Conditions") and other information in this brochure/website. The Rally Operator accepts bookings subject to the Booking Conditions.
The client is deemed to understand and accept these Booking Conditions at the time of booking.
The Rally Operator will use its best endeavours to operate the Rally as advertised, however changes to the itinerary may be made where deemed necessary by the Rally Operator. The Rally Operator reserves the right to change any of the accommodation, facilities, services, activities or prices of the Rally as described in the brochure and/or the website before or after departure of the Rally without notice or compensation to the client. The Rally Operator will make all reasonable efforts to inform the client of any changes to the itinerary prior to and/or during the Rally. The client expressly acknowledges and accepts that due to the nature and location of the Rally, changes to the itinerary may be unavoidable, and delays, inconvenience, discomfort or disappointment are possibilities.
Payment of your adventure:
The deposit of $5,000nz is payable to the Rally Operator at the time of booking. The deposit is non-refundable.
The balance of all monies due, including all surcharges and any other associated costs, must be paid to the Rally Operator not later than 90 days before departure of the Rally. In the case of non-payment of the balance by the due date, the Rally Operator reserves the right to deem the booking as cancelled by the client.
If we cancel your holiday:
The Rally Operator reserves the right to cancel the Rally in any circumstances, but will use its best endeavours not to cancel the Rally less than 8 weeks before the departure date. In the event of Force Majeure or Consolidation the Rally Operator shall have the right to cancel the Rally at any time. The Rally Operator, upon cancellation, will return all monies paid excluding any surcharges and associated costs reasonably incurred by the Rally Operator. In the event of the client's failure to pay the final balance, the Rally Operator shall have the right to cancel that client's Rally, and the Rally Operator shall have no obligation to return any monies already paid by the client.
"Force Majeure" means war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, charges imposed by rescheduling or cancellation of flights by an airline or other similar events beyond the Rally Operator's reasonable control.
"Consolidation" means and refers to the fact the Rally is dependent upon a minimum number of vehicles participating and that minimum has not been reached.
If you cancel your holiday:
Should the client wish to cancel, cancellation charges will be imposed. These are calculated from the day written notification of cancellation is received by the Rally Operator as follows:
- 180 days or more before departure - loss of deposit.
- Between 90-179 days prior to trip departure - 50% of total booking costs.
- Less than 90 days prior to departure - 100% of total booking cost.
It is strongly recommended that full insurance is taken out which includes but is not limited to cover, under certain circumstances, against the loss of deposit or cancellation charges. No refunds will be made if the client voluntarily leaves the Rally for any reason after it has begun. Refunds will be at the discretion of the Rally Operator if the client is involuntarily forced to leave the Rally for any reason. No refunds will be given for any accommodation, transport, sightseeing activities or other services not utilised by the client.
The Rally is a group activity and a level of participation is expected. The client shall at all times during the Rally comply with the laws, customs, regulations and rules of India.
The client understands and accepts that the authority and decisions of the Rally Operator, its' employees, agents and representatives whilst on the Rally in all matters are final. If, in the opinion of the Rally Operator, the health, level of fitness or conduct of a client at any time before or after departure appears likely to endanger the safety, comfort or happy progress of the Rally, the client may be excluded from all or part of the Rally without refund or recompense.
If a client commits an illegal act or breaches these Booking Conditions the client may be excluded from the Rally and the Rally Operator will cease to have responsibility to/for that client. No refund will be given for any unused accommodation, transport, sightseeing, activities or other services. If the client is affected by a condition, medical or otherwise, that might affect the client's or other people's enjoyment of the Rally, the client must advise the Rally Operator at the time of booking. If the Rally Operator reasonably believes that full details were not given at the time of booking, the Rally Operator may cancel the Rally for that client and no refund will be given.
Prices quoted are based on currency rates as at 1 July 2013, however external factors may affect those prices, including but not limited to exchange rates, transportation, price of fuel and accommodation. The Rally Operator reserves the right to alter the price of the Rally at any time and forward an amended invoice to the client. The Rally Operator will endeavour to notify the client of any price increase more than 26 weeks before departure of the Rally.
The Rally Operator does not accept any liability for personal injury, death, delay, loss of any nature, damage, inconvenience or additional expenses resulting from acts, omissions or negligence of the Rally Operator, its employees, agents or representatives before or during the Rally. The client to the fullest extent permitted waives any right of action the client might have against the Rally Operator for personal injury, death, delay, loss of any nature, damage, inconvenience or additional expenses incurred during the Rally or while travelling to or from the Rally.
IMPORTANT NOTE: This event has potential dangers; it
passes through regions and districts which may be hazardous. Some roads are
basic in the extreme and travels to altitudes in excess of 16,000 feet (5,000
metres). It is expressly designed to represent a challenge to participants and
may test your stamina, resourcefulness, and initiative. You should not enter
“Jingers Jaunts Indian Escapade 2014” unless you accept the element of risk to
yourself, your companions, and your vehicle. The onus is on you to access each
risk behaving carefully and to adhere to the laws of each region through which
the event passes.
Motor Vehicle Insurance:
While it is the Rally Operator's intention to provide clients with leads as to where to secure motor vehicle and road insurance for the Rally, it is not an obligation. The client expressly agrees and acknowledges that the Rally Operator will not be responsible for securing any insurance cover for the client. The Rally Operator recommends that the client take out comprehensive insurance cover.
Travel Insurance is compulsory for all clients. The client's own travel insurance must as a minimum provide cover against personal accident, medical expenses, emergency repatriation and personal liability. The Rally Operator also recommends it covers cancellation, curtailment and loss of luggage and personal effects. The Rally Operator accepts no responsibility for the loss of, or damage to, personal property or valuables. The Rally Operator reserves the right to request details of the client's insurance policy.
Health and fitness:
Whilst the Rally may not be physically demanding, each client should be in excellent health to participate in the Rally and be prepared to drive for long hours each day. The Rally Operator recommends the client consult their doctor for vaccination and other medical requirements for the Rally and other general health and medical matters that may be associated with travelling in the region of the Rally.
Passports, Visas and Health
Clients must carry a valid passport and have obtained the appropriate visas and health documents before departure of the Rally. The passport must be valid for not less than 6 months beyond the duration of the Rally. It is the responsibility of the client to ensure they are in possession of the correct visas for the Rally. The Rally Operator cannot accept responsibility, liability or consider refunds if a client cannot travel or is refused entry because of the lack of or incomplete documentation.
The booking from the client is accepted by the Rally Operator on the basis that the client accepts and understands the risks and hazards involved in a Rally of this nature in India, including injury, disease, loss, damage or discomfort. The client expressly acknowledges that it may be exposed to an element of personal risk and accepts and consents to the inherent risks and the limitation of the Rally Operator's responsibility and liability.
The governing law for all matters arising from these Booking Conditions and the Rally is New Zealand law and the client acknowledges the exclusive jurisdiction of the New Zealand courts.
